Redneck , I don't think I can help your buddy out. Still trying to get my money back through the courts. Do you still live next to Billy? Tell your buddy to try small claims court in your county.
 
I am not a lawyer, but what you describe seems to be common larceny, theft. He took your money under false pretense. If you live in a small town or if you have some connections, ask that a warrant be issued for his arrest. Easy for some cretin to ignore civil suit.....not so easy when the Sheriff shows up at the door.
 
Just an update on the R&O situation. As of know there are 5 different guys I know of that have been ripped off by Billie. Billie has finally been served paperwork for small claims court not by me but another guy he ripped off. We have filed police reports and are waiting to hear back from the DA in Granbury. No court date yet.

Here's a tip from an old bill collector:

You and the others can get him served AT THE COURT HOUSE when he has to appear for the first case. You can't do it in the court room, but there is nothing wrong with getting him in the hallway or lobby. Of course, he has to show up for the court date to make it work...

Someone should sign a complaint with the police and get a warrant for his arrest. If he's ripped off 5 people, he could be a flight risk.
 
From what I have read about small claims is that they can make a judgement against him but it is up to you to collect the debt. You will have to read up the process. He won't willingly comply with the judgement, from what I have read here.
I am happy to see that, on this site alone, 36,500 people are aware of him being a thief. He's toast!

^ +1 I agree, a civil suit in small claims court has no bearing or relation to a theft charge, they are different.

If you have a copy of the check, go to his local Police department and file theft/fraud charges. If you made the transaction through the mail you can also contact the ICC (Interstate Commerce Commission) a Federal Regulatory Agency that regulates Inter-State transactions, and also file a mail fraud charge with your postmaster.

Follow through and don't drop the charges if he makes a payment. He deserves to do some time for being a scum bag thief....

True if he doesn't want to pay, you will have to put a lien on his home, he cannot sell until the lien-holder has been paid in full.

He's toast!
