• xenforo has sucessfully updated our forum software last night. Howevr, that has returned many templates to stock formats which MAY be missing some previous functionality. It has also fixed some boroken templates Ive taken offline. Reat assured, we are working on getting our templates back to normal, but will take a few days. Im working top down, so best bet is to stick with the default templates as I work thru them.

does any one know how to copy right you BBQ loge so no one can use it ????

Just by using it first, you have something of a copyright on it. However, if someone else uses it, you can only sue for damages unless you've registerred it officially. If you have, you can also sue for punitive damages.

Guys, Jim Beam sponsors York's team and if I recall correctly, he is a distributor. He also has written permission to use the bottle in his logo.
 
After doing all the reading it seems that you cannot copyright your name or your logo. They must be trademarked and it will cost about $325 each.

Not true. You have rights without registration. However, you will have a harder time proving your rights to it. Had it first, blah, blah. You have a stronger case if it is registered.

Trademark & Service Mark are all the same thing really. Just indicates that you have some rights to it. Registration mark (Circle R) means that it is registered with the USPTO.

Wikipedia: Unregistered trademark rights may be enforced by way of a lawsuit for passing off, while the exclusive rights which attach to a registered mark can be enforced by way of an action for trademark infringement.

You do not need to add a TM, SM or circle R to your name or logo to exercise your rights to it. It helps, but isn't 100% necessary.

so what's not true about what I said? I didn't say it's easy; if someone uses your stuff, you have to prove it was yours first. That can be tough to do. You also can't sue for punitive damages then, only real damages.

That's what I was commenting on. You can sue for damages.

Ok... But you can only sue for real, not punitive damages. I've had to do it before (not with bbq stuff)... I fortunately had the registration done.
 
so to re cap the bottel is allready trade marked

but the logo will need to be regustared

with the letter from jim beam saying that they have gave me permision to use there bottel
