Default Making a commercial sauce your own?

Hey All.

I just wanted to get your advice on this. Is there any kind of "rule" regarding" using a commercial barbecue sauce as a base for your own and then selling it? I obviously know you can't take Bulls Eye and put it in a new bottle and sell it as your own, but I was talking to a buddy recently and he's been approached to sell some sauce at a local farmers market and he uses about 1/4 cup commercial sauce in his sauce recipe that makes about 4 cups. I didn't think that was enough to be a problem, but wasn't sure. I suggested making a base sauce but costs obviously could be kept down otherwise. He isn't looking to get rich off this just get his name out there. Anyone have any experience with this? Thanks in advance.
