Making a commercial sauce your own?
 
Hey All.

I just wanted to get your advice on this. Is there any kind of "rule" regarding" using a commercial barbecue sauce as a base for your own and then selling it? I obviously know you can't take Bulls Eye and put it in a new bottle and sell it as your own, but I was talking to a buddy recently and he's been approached to sell some sauce at a local farmers market and he uses about 1/4 cup commercial sauce in his sauce recipe that makes about 4 cups. I didn't think that was enough to be a problem, but wasn't sure. I suggested making a base sauce but costs obviously could be kept down otherwise. He isn't looking to get rich off this just get his name out there. Anyone have any experience with this? Thanks in advance.

you can go to a couple commercial bottlers who will sell you a base that you modify yourself or w/ their help. they will then bottle & label it for you & do part of the marketing. i can't remember the names right off hand but it's on history channel's modern marvels-bbq tech every now & then.

they usually do batches of 60gal minimum.

It is illegal to use a prepared copyrighted product as part of your product without an agreement from the manufacturer or the copyright holder. Of course you can try to recreate the product as close as possible through reverse engineering in your kitchen. You cannot however pay a firm to do the engineering for you. But since pre-packaged food products are required to list there ingredients in order of predominance after a few attempts in the kitchen you should be able to get a product very close to the store brought brand.
